4. Conditions for Acceptance of Exchange
All products approved for exchange must be returned in their original, unused, unworn, unwashed and unaltered condition, with all original tags, labels, barcodes, brand seals, packaging and invoice intact. The Company reserves the right to conduct a quality inspection upon receipt, and any product failing such inspection shall be deemed ineligible for exchange, without any liability on the Company.
5. Process for Initiating Exchange
All return or exchange requests must be initiated by the User through the Platform using the account from which the order was placed or by contacting authorised customer support channels within the applicable return or exchange window, and the User shall be required to provide complete and accurate order details, reason for return or exchange, and such photographs, videos or additional information as the Company may reasonably require for verification, and the Company reserves the right to approve or reject the request based on the information provided and its internal policies.
6. Discretion of the Company
Notwithstanding anything contained in this Policy, the Company retains full and absolute discretion to approve, deny or restrict any return or exchange request based on product category, hygiene and safety considerations, resale suitability, customer purchase and return history, fraud risk, quality inspection results and internal business policies, and the Company’s decision in this regard shall be final and binding on the User and shall not be subject to challenge except where expressly required by applicable consumer protection law.
7. Mode and Availability of Exchange
Approved exchanges shall be limited strictly to the identical product in a different size, colour or variant, subject to availability. Where the requested exchange cannot be fulfilled due to stock unavailability, the Company may, at its sole discretion, issue store credit, and no refund shall be provided.
8. Non-Eligible Products
Notwithstanding anything contained in this Policy, the following products shall not be eligible for exchange under any circumstances:
(a) custom-made or made-to-measure products;
(b) sale or discounted products; and
(c) accessories.9. Reverse Pickup and Shipping Charges
All original shipping charges are non-refundable. Exchange-related shipping, handling or reverse pickup costs shall be borne by the User unless the exchange is necessitated due to an error solely attributable to the Company.
10. Damaged or Incorrect Products
In the event the User receives a damaged, defective or incorrect product, the User must notify the Company at support@nitikabali.com within forty-eight (48) hours of delivery, along with clear supporting images and complete order details. Failure to report within the prescribed time period shall result in rejection of the claim.
11. Non-Compliance and Abuse of Policy
Any misuse, abuse or manipulation of the exchange facility, including but not limited to repeated returns, returning worn or used products, removing or tampering with tags, making false damage claims or attempting to exploit promotional offers, may result in permanent suspension of the User’s account, blacklisting of the User from future returns or exchanges and such other legal or contractual action as the Company may deem appropriate.
12. Legal Compliance
This Policy has been framed in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-commerce) Rules, 2020, and nothing contained herein shall be deemed to restrict or waive any statutory consumer rights that are mandatorily applicable; however, where the law permits discretion, the Company’s policies shall prevail.
